The "Regulations" issued this time focus on outstanding issues in the field of consumption and make clear provisions, including refining and supplementing relevant regulations on operator obligations, improving relevant regulations on online consumption, strengthening prepaid consumer operators 'obligations, standardizing consumer claims, and clarifying government responsibilities for protecting consumer rights and interests.

Recently, Premier Li Qiang of the State Council signed a State Council order to promulgate the "Regulations on the Implementation of the Law of the People's Republic of China on the Protection of Consumer Rights and Interests"(hereinafter referred to as the "Regulations"), which will come into effect on July 1, 2024. This adds another "firewall" to the protection of consumer rights and interests.

The "Regulations" address false publicity, unfair format clauses, prepaid consumer infringement, etc. in the traditional consumer field, as well as abuse of technical means, platform rules, and dominant positions by operators in the platform economy field to infringe on consumer rights and interests, including price discrimination, big data "familiar", false marketing,"replacing fake products for real products" and "replacing shoddy products" in online live broadcasts, and excessive collection of consumer personal information have made corresponding provisions on consumer infringement issues that have attracted widespread attention in society. And further strengthen the protection of consumer rights and interests on the basis of the Consumer Rights and Interests Protection Law.

In fact, in recent years, China has introduced relevant laws and regulations in the field of consumption, such as the Consumer Rights and Interests Protection Law, the General Principles of the Civil Law, the Product Quality Law, and the Food Safety Law, which regulate the business activities of operators and protect consumers. Legal rights and interests play an important role. However, with the rapid development of China's economy and society, especially the continuous development of new business formats and models such as the platform economy, some new situations and new problems have also emerged in the protection of consumer rights and interests.
