Recently, the People's Procuratorate of Nanchang County, Jiangxi Province, filed a public prosecution for a case of military marriage sabotage and submitted sentencing recommendations to the court.
In the month of the year, soldier Li, who was serving in Hangzhou, registered for marriage with Chen through an introduction by their families. Gong, knowing that Chen was already a spouse of a soldier, continued to maintain a cohabiting relationship with Chen in Xiangtang Town, Nanchang County. At the end of the month, after Li discovered the possible relationship between the two and reported it, the public security authorities, facing difficulties in evidence collection due to the special identity of the victim, Li, who was serving in Hangzhou, had doubts about whether the case met the criteria for filing. The Hangzhou Military Procuratorate, through collaboration between military and civilian authorities, forwarded the lead to the Nanchang County People's Procuratorate.
Nanchang County People's Procuratorate contacted the military and the victim, Li, and held joint consultations with the public security authorities, fully listening to the opinions of the military and servicemen. After the public security authorities filed the case, they initiated the specialized handling of military-related cases, with designated personnel involved early to guide the investigation and evidence collection, leading to a swift resolution of the case. After Gong was apprehended, he truthfully confessed to the criminal facts, deeply regretting his actions that damaged the military marriage. He pleaded guilty, accepted punishment, and signed the "Written Consent."
Article 259 of the Criminal Law of the People's Republic of China states: Whoever knowingly cohabits with or marries the spouse of an active serviceman shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention. Destroying the marital and family life of servicemen is not only subject to moral condemnation but also to legal sanctions!
