Notice from the National Development and Reform Commission, the National Energy Administration, the Ministry of Justice, and the National Office for Popularizing Law on Studying, Propagating, and Implementing the "Energy Law of the People's Republic of China"
《中华人民共和国能源法》已由十四届全国人大常委会第十二次会议于年月日表决通过,国家主席习近平签署第三十七号主席令予以公布,自年月日起施行。为切实做好能源法学习宣传和贯彻实施工作,现就有关事项通知如下。
一、充分认识贯彻落实能源法的重要意义
The Energy Law is a foundational and overarching legislation in the energy sector, serving as the fundamental guideline for energy-related work. It embodies the practical application of Xi Jinping Thought on the Rule of Law within the energy industry and represents the legal crystallization of energy reform and development under the guidance of the new energy security strategy. The law systematically outlines the major policies, fundamental principles, and key institutional frameworks for China's energy development. It holds significant and far-reaching implications for further solidifying the legal foundation of the energy sector, advancing high-quality energy development, and safeguarding national energy security.
All regions and departments must fully recognize the significance of formulating and implementing the Energy Law, and carry out energy-related work in the new era with a stronger sense of mission and responsibility.
2. Deeply carry out learning and publicity activities on the Energy Law.
The Energy Law consists of nine chapters and eighty articles, stipulating the fundamental principles and requirements for energy-related work. It covers all aspects and stages of energy operations, including energy planning, development and utilization, market systems, reserves and emergency response, technological innovation, and supervision and management.
All regions and departments must regard the study and implementation of the Energy Law as an important part of learning and implementing Xi Jinping Thought on the Rule of Law. They should organize learning and publicity activities in close connection with the actual work of their respective regions and departments, effectively enhancing the relevance and effectiveness of implementation.
Leaders at all levels in the energy system must lead by example, taking the initiative to study the Energy Law and consciously serving as models in respecting, learning, abiding by, and applying the law, thereby setting a benchmark for others. Efforts should be intensified in training, diversifying learning methods, and innovating communication channels to ensure the Energy Law becomes essential knowledge for all personnel in the energy sector. Learning sessions on the Energy Law and related regulations should be organized in various forms to comprehensively grasp its essence and core principles in a timely manner.
Energy authorities at all levels shall incorporate the Energy Law into the theoretical study programs of Party committees (leading Party members groups) and earnestly organize specialized training sessions. They should also widely conduct public legal awareness campaigns on energy to foster a sound environment for the rule of law.
3. Solidly Implement the Energy Law
All regions and departments should take the introduction and implementation of the Energy Law as an opportunity to promptly formulate or revise local energy regulations, rules, and normative documents in line with their actual work conditions, ensuring seamless alignment with the energy legal framework.
Energy authorities at all levels must fulfill the statutory duties conferred by the Energy Law, carry out their work strictly in accordance with legal mandates and procedures, and embed the rule of law in every aspect and at every stage of energy-related work. They should rigorously advance law enforcement that is strict, standardized, impartial, and civilized, while continuously enhancing their ability and proficiency in leveraging legal thinking and methods to drive energy reform and development. Additionally, they must actively guide the whole society in fulfilling the obligations of green energy use and energy conservation, uniting powerful forces to promote high-quality energy development.
All regions and departments must regard the study, promotion, and implementation of the Energy Law as a crucial task, carefully planning and advancing it with solid efforts to effectively strengthen organizational leadership and overall coordination. Energy authorities at all levels should research and formulate work plans for the implementation of the Energy Law, meticulously organizing the execution of various tasks.
