新利好!2025年起职工养老保险增加病残津贴
人力资源社会保障部、财政部18日发布《企业职工基本养老保险病残津贴暂行办法》。办法明确,自2025年1月1日起,企业职工基本养老保险参保人员达到法定退休年龄前,因病或者非因工致残经鉴定为完全丧失劳动能力的,可以申请按月领取病残津贴。
The monthly standard and payment duration of disability allowances are determined based on the age and cumulative years of contributions of the insured individuals at the time of applying for disability allowances. The monthly standard of disability allowances is adjusted in tandem with the national unified adjustment of the basic pension level.
Participants in the insurance program who receive disability pensions shall have their place of benefit entitlement determined in accordance with the relevant regulations on the transfer and continuation of national basic old-age insurance relationships. During the period of receiving disability pensions, basic old-age insurance premiums are no longer required to be paid. If the participant finds employment again and pays according to national regulations, the disability pension will cease from the month following the resumption of premium payments.
The regulation requires that applicants for disability benefits must hold a complete loss of labor capacity assessment conclusion issued by a labor capacity appraisal institution at or above the prefectural (municipal) level in the place of benefit receipt or the last place of insurance participation. The provincial human resources and social security department establishes a labor capacity re-appraisal system for disability benefit recipients. If a re-appraisal determines that the individual no longer meets the criteria for complete loss of labor capacity, disability benefits will be suspended from the month following the re-appraisal conclusion.
The funds required for disability benefits are paid from the basic endowment insurance fund. Those who fraudulently obtain disability benefits through deception, falsification of proof materials, or other means will be ordered by the human resources and social security department to refund the benefits and will be held accountable in accordance with relevant legal regulations.
By the end of the year, the number of people nationwide participating in the basic old-age insurance for enterprise employees reached tens of millions, an increase of millions compared to the end of the previous year. In accordance with the relevant arrangements, starting from 2024, the statutory retirement ages for male employees, female cadres, and female workers will be gradually extended to 65, 60, and 55 years old, respectively.
