In order to thoroughly implement the spirit of the 20th National Congress of the Communist Party of China and the Second Plenary Session of the 20th Central Committee of the Communist Party of China, conscientiously implement the new energy security strategy, implement the decisions and arrangements of the Party Central Committee and the State Council on promoting supply guarantee and price stability of primary products, deepen structural reforms on the coal supply side, innovate production capacity management mechanisms, improve production capacity reserve policies, promote coal production capacity to maintain reasonable margin and sufficient flexibility, enhance supply guarantee capabilities, and better play the role of coal in ensuring energy supply, Formulate the following implementation opinions.

1. Overall requirements

Give full play to the decisive role of the market in resource allocation, better play the role of the government, actively adapt to changes in the coal supply and demand situation, form stable production capacity reserve support policy expectations, and actively guide qualified enterprises to build coal reserve production capacity. Focusing on large-scale modern open-pit coal mines and underground coal mines with high safety guarantees, we will select a number of coal mines with reserve capacity in new and under construction coal mine projects, and actively and steadily organize implementation. Maintain reasonable and sufficient coal production capacity, enhance the elasticity and flexibility of coal supply, and effectively respond to cyclical and seasonal fluctuations in coal supply. Vigorously improve the quality of green production, promote the coordination of production capacity reserve and ecological and environmental protection, increase investment in safety and security, and ensure safety and reliability during the daily maintenance and release of reserve production capacity.

By 2027, a coal production capacity reserve system will be initially established, and a number of production capacity reserve coal mine projects will be approved in an orderly manner to form a certain scale of dispatchable production capacity reserve. By 2030, the capacity reserve system will be more sound, the capacity management system will be more perfect, and strive to form a programmable capacity reserve of about 300 million tons/year, the national coal supply guarantee capacity will be significantly enhanced, and the supply elasticity and toughness will continue to improve.

2. Working rules for the construction of coal mines with capacity reserve

Capacity reserve The design capacity of a coal mine consists of two parts: regular production capacity and reserve production capacity. Conventional production capacity refers to the normal production capacity of coal mines under non-emergency conditions. Production is independently organized by enterprises according to market conditions and is not included in the scope of unified national dispatch. Reserve production capacity refers to the production capacity of moderate scale reserved on the basis of regular production capacity and used for peak shaving. In emergency situations, it is released simultaneously with regular production capacity according to unified national dispatch to achieve "upward elastic production" of coal mines. Capacity reserve The sum of the regular production capacity and reserve production capacity of the coal mine is the design production capacity. During the construction process of capacity reserve coal mines, implementation should be organized in accordance with the following requirements:

(1) Planning Stage. During the preparation (revision) of the coal mining area overall planning, the overall planning preparation departments of coal mining areas at or below the provincial level shall organize research on the planning, construction and in-construction coal mine projects in the mining area, and demonstrate whether the projects meet the conditions for the construction of reserve production capacity, and scientifically and reasonably determine the construction scale of individual coal mines. In principle, a reserve production capacity coal mine should be built and put into production once in accordance with the designed production capacity. The project unit shall conduct an in-depth study on the feasibility of constructing a reserve production capacity coal mine to ensure that it is economically reasonable and safe and controllable. The export infrastructure outside the mining area shall fully consider the situation of the release of reserve production capacity.

(2) Approval Phase. New coal mine projects planned for the construction of reserve production capacity shall handle land preliminary examination, site selection opinion, and social stability risk assessment report in accordance with the designed production capacity. When compiling the project application report, the construction and production plan of reserve capacity shall be deeply analyzed. Under-construction coal mine projects can construct reserve capacity on the basis of the existing approved production capacity, or can apply for adjustment of construction scale in accordance with relevant policy requirements and then construct reserve capacity.

(III) Construction phase. Based on compliance with the overall mining area planning and planning environmental impact assessment, the production capacity reserved coal mine shall complete the procedures of mining, land, forest, grass, environmental impact assessment, water withdrawal permission, water conservation, safe production, etc. in accordance with the design production capacity to create conditions for the legal and compliant release of the reserved production capacity. The production, transportation, ventilation, drainage, electrical and mechanical systems and related equipment of the coal mine shall be constructed and equipped in accordance with the design production capacity to ensure that the reserved production capacity can be safely and effectively released in an emergency. The production capacity reserved coal mine mainly forms production capacity reserved by increasing the mining capacity and improving the advancing speed of the working face, and it is not achieved by increasing working faces. It is necessary to strengthen construction safety management and strictly implement the "three synchronization" system of safety facilities.

(IV) Acceptance stage. After the project enters joint trial operation, trial production will be organized according to the designed capacity and the conventional capacity, respectively. Within the specified joint trial operation period, the project unit can independently determine the time for organizing trial production according to the two capacities based on the actual conditions of the coal mine. When organizing the completion acceptance, the project unit shall clarify the construction status of the capacity reserve in the completion acceptance report. The coal industry management department of the province shall strengthen the supervision of the project completion acceptance activities. If the capacity reserve construction fails to meet the requirements, the project unit shall be ordered to rectify it, and the project can be completed and put into operation only after it meets the requirements.

(5) Production stage. Coal mines with capacity reserve must improve the "flat-to-emergency conversion" mechanism, study and formulate work plans for organizing production according to regular production capacity and designed production capacity, rationally arrange production organizations, maintain a safe and stable production order, and give full play to the role of capacity reserve. On a daily basis, we must reasonably allocate personnel and scientifically arrange mining (stripping) and continuation, and prepare for emergency production in advance. In emergency situations, we must resolutely obey the unified dispatch of the state and quickly release reserve production capacity to ensure that production is available, adjusted quickly and usable. It is necessary to effectively increase investment in production safety, strengthen the investigation and management of hidden dangers, and continuously enhance the ability to ensure safe supply.

3. Management procedures for coal mines with capacity reserve

(1) Application Conditions. Coal mines applying for construction and reserve capacity should be new or under construction coal mine projects, which are within the approval authorities of the National Development and Reform Commission and the National Energy Administration. The scale of reserve capacity of coal mines shall be divided into three levels with 20%, 25% and 30%, respectively, according to the proportion of designed capacity of coal mines. The mining areas, where the reserve capacity of coal mines is located, should meet the conditions such as convenient outbound transportation and sufficient transportation capacity, and the products of coal mines shall be mainly used to ensure power generation, heating, and people's livelihood.

(2) Declaration procedure. The coal industry management departments of the coal producing provinces and autonomous regions, together with the development and reform departments of the same level (or the coal investment management departments designated by the provincial government), shall organize the declaration of the coal mines with production capacity reserve in the province or autonomous region based on this implementation opinion and relevant notice requirements. Coal enterprises (including central enterprises) shall prepare production capacity reserve construction plans and submit applications based on the actual conditions of resource conditions, mining technology, and external transportation conditions. The coal industry management departments of relevant coal producing provinces and autonomous regions, together with the development and reform departments of the same level (or the coal investment management departments designated by the provincial government), shall conduct the preliminary review and submit the coal mine projects that meet the declaration conditions to the National Energy Administration.

(3) Confirmation process. The National Energy Administration shall commission relevant assessment institutions to organize experts to conduct assessments on coal mining projects that have applied to build reserve capacity. The coal mining project list and reserve capacity construction scale shall be comprehensively determined according to the assessment results. The large modern opencast coal mines or safe underground coal mines in the five major coal supply security bases in Shanxi, Western Inner Mongolia, Eastern Inner Mongolia, Northern Shaanxi, and Xinjiang shall be prioritized.

IV. Enabling mechanism When the overall coal supply and demand situation is balanced, the production capacity reserve coal mines shall organize production according to the regular production capacity after they are put into production. When the supply and demand situation changes from overall balance to tension, the National Development and Reform Commission and the National Energy Administration shall implement unified scheduling of reserve production capacity based on the coal market's supply and demand and whether the prices exceed the reasonable range, and determine the emergency release areas of reserve production capacity, the production scheduling scale, and the supply guarantee targets, guiding the reserve production capacity coal mines to "elastic production upwards" in stages according to the design capacity under the premise of ensuring safety.

(V) Long-term contract signing. The coal reserve mine shall strictly fulfill the responsibility of ensuring coal supply and stable price, sign medium and long-term power coal contracts according to the relevant requirements, and implement the relevant state price policies. The commercial coal produced by the capacity reserve mine shall be subject to the national unified dispatch and shall no longer assume the task of signing local medium and long-term contracts.

4. Supporting support policies

Provide incentives for capacity swap policies. For capacity reserve coal mines, new coal mines will be built with reserve capacity equal to 20%, 25% and 30% of the designed capacity, and 60%, 80% and 100% of their new capacity (including regular capacity and reserve capacity) will be exempted from implementing the capacity swap. For those whose capacity swap plan has been reviewed and confirmed (including coal mines under construction), 60%, 80% and 100% of their total capacity swap indicators may be used separately, and the indicators will no longer be converted.

(2) Optimizing and adjusting the overall planning of coal mine areas and planning environmental impact assessment requirements. Coal mines with production capacity reserves shall strictly handle the approval procedures in accordance with the approved overall planning and planning environmental impact assessment of coal mine areas. When there are significant changes in resource reserves and mining conditions, on the premise of meeting the service life requirements, the designed production capacity can fluctuate by 1 to 3 design levels on the basis of the overall planning of the coal mine area, and the maximum increase should be less than 30% of the planned construction scale, and without appearing in the Circular on Further Strengthening Environmental Impact Assessment Management of Coal Resource Development (Huanhuan-ping [2020] No. 63) stipulated major adjustment circumstances of the plan. The above optimization and adjustment is not a major adjustment of the overall planning of the coal mine area, and a partial adjustment plan can be prepared and submitted to the original planning approval authority for approval.

(3) Implement the independent listing of coal new capacity targets. For production capacity reserve coal mines, the reserve production capacity scale will not occupy the new capacity targets of the provinces and regions determined by the national coal development plan.

5. Safeguard measures

(1) Enhance organizational coordination. Establish a management mechanism for the coal production capacity reserve, strengthen overall guidance and coordination, and coordinate the nationwide coal production capacity reserve work. The relevant coal industry management authorities at the provincial and regional coal-producing areas and the departments of development and reform at the same level shall establish a provincial-level working mechanism in accordance with the actual situation and guide enterprises in the region to undertake production capacity reserve work.

(2) Consolidate work responsibilities. Project entities of planned coal mines for capacity reserve shall strictly perform their main responsibilities, solidly advance the construction of planned coal mines for capacity reserve, ensure the completion of construction tasks on time with guaranteed quality and quantity, organize production according to the unified national plan, and effectively play the role of planned coal mines for capacity reserve. Provincial coal industry management departments shall perform their supervisory and administrative responsibilities, strengthen their daily supervision over planned coal mines for capacity reserve within their jurisdiction, establish work ledgers for each mine, monitor and master the production of planned coal mines for capacity reserve in both non-emergency and emergency situations, and report relevant ledger information to the National Development and Reform Commission and the National Energy Administration on a regular basis.

(III) Strengthen Supervision and Administration. The National Energy Administration, together with relevant departments, shall strengthen comprehensive coordination and supervision over the national coal production capacity reserve, study and solve major issues in the construction and production of production capacity reserve coal mines, and promote the orderly implementation of all aspects of production capacity reserve. Coal industry management departments at the provincial level shall organize inspections in a timely manner. For those who fail to organize construction and production in accordance with relevant national regulations, they shall be ordered to make rectifications within a time limit, and those who violate relevant laws and regulations shall be punished in accordance with regulations to ensure that various requirements are implemented.

This implementation opinion is interpreted by the National Development and Reform Commission and the National Energy Administration. It will come into effect as of the date of issuance and will be valid for 5 years.
